Terms of Use

1. Presentation of the service

OuChiner (hereinafter "the Service") is an online platform available at ouchiner.com that allows users ("Buyers") to locate antique shops, second-hand dealers and events (flea markets, house clearances, fairs) in France, and professionals ("Advertisers") to list their business.

The Service is published and operated by Ouchiner, a simplified joint-stock company with a sole shareholder (SASU) with share capital of €1,000, registered with the Épinal Trade and Companies Register under number 106 905 938, whose registered office is at 39 rue Alix le Clerc, 88500 Poussay, France, represented by its president Mr Stéphane Perry (hereinafter "the Publisher").

2. Access to the service

Access to the map and to viewing listings is free and requires no registration for Buyers. Access to the Advertiser area requires the creation of an account and acceptance of these Terms.

3. Registration and Advertiser account

To list a shop or publish an event, the Advertiser must:

4. Plans and pricing

Listing a shop (antique dealer, second-hand dealer, consignment shop, Emmaüs, etc.) is offered in two formats:

5. Payment

Payments are processed by Stripe, a secure payment provider. OuChiner stores no banking data. By taking out a subscription, the Advertiser authorises automatic recurring collection.

6. Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content whose performance has begun with the consumer's agreement.

7. Liability

The Publisher undertakes to keep the Service accessible to the best of its ability, without guaranteeing permanent availability. The Advertiser is solely responsible for the information published on their listing (accuracy of opening hours, address, description, photos).

The Publisher reserves the right to remove without notice any content that is unlawful, misleading or contrary to public decency.

8. Intellectual property

The Service, its interface, its texts and its source code are the property of the Publisher. Content published by Advertisers (photos, descriptions) remains their property, but they grant OuChiner a non-exclusive licence to display it on the platform.

By publishing photos of items through their professional area ("My items"), the Advertiser grants OuChiner a free, non-exclusive, worldwide licence for the duration of publication, authorising it to: display, resize and reproduce those photos across the whole Service (listing, the "/chiner/" finds wall, discovery feed, event pages); generate a descriptive text and a title from them for accessibility and search-engine optimisation purposes; and feature them, where applicable, on OuChiner's official social-media accounts to promote the dealer. The Advertiser warrants that they hold the rights to the photos they publish. The photos remain their property; they may remove them at any time from their area, which terminates the licence for the future.

10. Amendments to the Terms

The Publisher reserves the right to amend these Terms at any time. Advertisers will be informed by email of any substantial change. Continued use of the Service constitutes acceptance of the new terms.

11. Reporting illegal content (DSA)

In accordance with the European Digital Services Act (DSA), any user may report illegal content published on OuChiner (listing, event) using the reporting button available on each listing, or by email to [email protected]. We will handle every report as promptly as possible.

12. Consumer mediation

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, if a dispute cannot be settled amicably, you may use the mediation service free of charge:

13. Affiliate links and imported listings

Some listings shown on OuChiner (the "Chiner" wall, shop pages, Feed) are imported automatically from partner merchant sites, in particular eBay, where the professional has published the link to their online shop on their listing. The professional may request their removal at any time, from their area or via the link provided in the information email sent to them.

Links leading to those merchant sites may be affiliate links: if you make a purchase after following them, OuChiner may receive a commission paid by the merchant site. This commission changes neither the price paid by the buyer nor the amount received by the seller — it is deducted by the merchant site from its own revenue.

Such links are identified at the point where they are offered. The selection and the order of the listings shown do not depend on any remuneration associated with them.

14. Governing law and jurisdiction

These Terms are governed by French law.

For professional Advertisers, any dispute falls within the jurisdiction of the courts of Paris.

For consumers, the statutory rules of jurisdiction apply and this clause is not enforceable against you: you may bring proceedings before the court of your place of domicile or that of the Publisher's registered office, and we may sue you only before the court of your domicile (Articles 17 to 19 of Regulation (EU) No 1215/2012, known as Brussels I bis).
